On 9 April 2026, https://legislation.ehsmonitor.com/AE/JUR/%D8%A7%D9%84%D9%82%D8%B1%D8%A7%D8%B1%20%D8%A7%D9%84%D9%88%D8%B2%D8%A7%D8%B1%D9%8A%20%D8%B1%D9%82%D9%85%2021%20%D9%84%D8%B3%D9%86%D8%A9%202026.pdf>Ministerial Decision No. 21 of 2026 Concerning the Regulation of Circulation of Single-Use and Recycled Plastic Products Intended for Food Contact (hereinafter, the Decision) was published in the UAE Official Gazette. The Decision applies to companies placing recycled plastic food contact materials (FCMs) and articles on the UAE market, including materials made from recycled polyethylene (rPE), recycled polypropylene (rPP), and recycled impact polystyrene (rIPS). It entered into force the day after publication, on 10 April 2026.
Prior to the issuance of this Decision, there was no dedicated regulatory framework in the UAE specifically addressing the placing on the market of recycled plastic materials intended for food contact applications, and such materials were generally subject to broader food contact safety requirements under existing legislation. Companies placing recycled plastic FCMs and articles on the UAE market must now comply with specific requirements intended to ensure the safety and suitability of recycled plastic materials for food contact use. In particular, companies must ensure that such materials are supported by appropriate testing, including migration testing and challenge testing, demonstrating compliance with applicable safety requirements.
Additionally, companies must ensure that recycled plastic materials are subject to risk assessments confirming their safety and suitability for their intended food contact applications. Companies must also maintain documentation demonstrating compliance and food contact safety, including relevant test reports and risk assessments, and make such documentation available to the competent authorities upon request.
Additional information
The Decision requires recycled plastic FCMs and articles to be supported by appropriate testing, including migration testing and challenge testing, demonstrating compliance with applicable food contact safety requirements. However, the Decision does not provide further guidance on the specific testing methodologies, parameters, or applicable limits for migration and challenge testing, which are determined under separate UAE standards and technical regulations.
The Decision also requires recycled plastic FCMs to be supported by risk assessments confirming their safety and suitability for food contact use. However, it does not provide further guidance on the methodology, criteria, or parameters for conducting such risk assessments, which are determined under relevant UAE standards and technical regulations.
In addition, the Decision requires companies to maintain documentation demonstrating the safety and compliance of recycled plastic FCMs. Such documentation includes, among others, relevant test reports and risk assessments supporting the safety of the materials for their intended food contact applications.
The Decision does not define the term "competent authorities"; however, this may include the Ministry of Industry and Advanced Technology and other relevant regulatory authorities in the UAE.
